TECHNICAL EXPERTISE FOR THE IDENTIFICATION OF A LAND PROPERTY

What does land property identification mean?

The problem of identifying landed properties in the cadastral map is a common case in practice. It arises because of the fact that during the years since the founding of the Third Bulgarian State (after the liberation from the Ottoman rule) to date, different laws for the notarial deeds and requirements for the drafting of the notarial acts have existed.

It is generally known that in the old fortress and notary deeds the property subject to the transaction is described with general and spatially and unambiguously defined parameters such as: area, type (levels, vineyard, havra etc.), locality and neighbors.

In modern conditions, with the presence of highly accurate cadastral maps in which  the spatial location of the property is unequivocally defined, and in the conditions of dynamic change of ownership, these descriptive characteristics in old acts are already losing their importance as parameters indicating uniquely what property is concerned and where it is.

The necessity of carrying out technical expertise for identification of the landed property arises when, on the basis of the data presented by the property document, it is not possible to uniquely determine the spatial location of the property. the coordinates of the border points.

The main purpose of the expertise foridentification of the landed property is to make a study by basing on the descriptive characteristics recorded in  the ownership documents and the cartographic materials available at the time of drawing up the notarial deed, to conclude the property with which identifier in the current cadastral map & amp;nbsp; & nbsp; refers to the old notary deed.

Expertise for Land Identification is a complex process requiring the analysis and processing of many and varied cartographic materials, inventory sheets and property registers including old aerospace proofs proving the location, configuration and topographic description of the property subject to the expertise.
